Terms of service
The agreement between you and ClimbX covering the service, your account, and what each side is responsible for.

1. Service
ClimbX provides a web application that helps creators on X grow their audience. It connects to your X account via X's OAuth, reads your recent posts to learn your voice, suggests new posts shaped by what works for accounts ahead of you in your niche, and lets you schedule posts for later publishing. AI-generated drafts are generally presented for your review or approval. Posts you schedule may publish automatically at the time you select, and connected applications may act within the permissions you authorize. ClimbX should not publish outside the authorization you give. By using the service you agree to these terms.
ClimbX is operated by D. Smidstrup Holding ApS(CVR 45751937), trading as Random Code, Havnegade 12, 3. 1, 5000 Odense C, Denmark. References to “we”, “us”, or “ClimbX” in these terms mean D. Smidstrup Holding ApS.
ClimbX is an independent product. It is not affiliated with, endorsed by, or sponsored by X Corp. or OpenAI. We integrate with X via X's public API and OAuth, and we use OpenAI's models via the official OpenAI API.
2. Accounts
You must sign in with a valid X account to use the service. By signing in you confirm that you own that X account and that you are at least 16 years old (or the minimum age of digital consent in your country, whichever is higher). You are responsible for keeping your X credentials secure and for everything that happens under your account. One account per person, unless you are on a plan that explicitly allows multi-account use.
3. Acceptable use
You may use ClimbX to draft, refine, and schedule your own X posts. You may not:
- Use ClimbX to violate X's terms of service or any applicable law.
- Post or schedule content that is illegal, defamatory, harassing, or that infringes third-party rights.
- Use ClimbX to spam, post auto-generated filler, or otherwise damage X's recommendation systems.
- Automate the app via scripts or bots to bypass plan limits or rate limits.
- Share your account with someone else who is not on a Premium / agency plan.
- Attempt to reverse-engineer ClimbX, resell it without permission, or use it to build a competing product.
You are responsible for the content you create, approve, schedule, or publish and for complying with the X Terms of Service, X Rules, and applicable law. ClimbX is responsible for operating its integration under the agreements and policies that apply to developers using the X API.
4. Plans and payments
ClimbX is a paid subscription service. Eligible first-time subscribers receive a 7-day free trial and must provide a valid payment method. If you do not cancel before the trial ends, the first monthly payment is charged when the trial ends. Returning subscribers may be charged immediately rather than receiving another trial. Subscriptions renew automatically each month until cancelled. Current prices are shown on the pricing page.
New subscriptions are processed through Stripe Managed Payments, where Stripe/Link acts as merchant of record and manages payment processing, fraud, disputes, transaction-level support, and indirect-tax compliance where its coverage applies. Existing subscriptions may remain on standard Stripe payments. Card details never reach our servers. For ClimbX product or account questions, email daniel@danielsmidstrup.com.
We may change prices with at least 30 days notice; price changes never affect a billing period already paid for. Founding-member pricing, when offered, is locked in for the lifetime of your subscription unless you cancel.
5. Cancellation
You can cancel your subscription at any time from your account page. After you cancel, access continues until the end of the current billing period. No further charges are taken. We do not refund partial periods.
6. Refunds
If you are a consumer in the European Union, you may have a statutory right to withdraw from the contract within 14 days. You may request that the digital service begins immediately. Your withdrawal right may be affected only where the legal requirements for doing so have been met; simply using one paid feature does not by itself determine the outcome. Outside the EU withdrawal window, monthly subscriptions are non-refundable for the current period - you can cancel at any time and will not be charged again. Annual subscriptions are non-refundable once the service has been used. If something goes wrong on our side, contact support and we will review on a case-by-case basis.

8. Content you provide
You keep all rights to your X posts, your drafts, and anything you type into ClimbX. By using the service you grant us a limited right to process that content for the sole purpose of providing the service (drafting suggestions, learning your voice, generating analytics). We do not sell your content and we do not train external AI models on it.
Aggregated, anonymized performance data may be combined across users to produce niche / size-band baselines (for example: “hot takes typically perform 2.1x baseline for accounts at 1k-5k followers in build-in-public”). Individual posts and identities are never surfaced in these aggregates. These aggregates persist even after you delete your account, because they no longer identify you. 9. Availability
We aim for high availability but do not guarantee uptime. The service depends on external systems (X API, OpenAI API, our hosting provider) that are outside our control. Scheduled maintenance, third-party outages, or force majeure events may cause downtime. We are not liable for losses caused by the service being temporarily unavailable.
10. Liability
ClimbX is provided “as is”. We make no guarantee that you will gain followers, impressions, or revenue from using it - growth on X depends on what you write, your niche, the X algorithm, and factors outside our control. Always review a draft before publishing.
X controls your account standing, not us. X is an independent third-party platform that controls account access, moderation, ranking, reach, visibility, API access, restrictions, suspensions, and termination. X may limit, restrict, deamplify, suspend, or terminate an account at its discretion. ClimbX does not control these decisions and does not guarantee that using the service will prevent your account or content from being affected. You remain responsible for the content you create, approve, schedule, or publish.
To the maximum extent permitted by law, ClimbX is not liable for actions independently taken by X, including restrictions, suspensions, reduced reach, loss of followers or revenue, or removal of content. This limitation does not apply to the extent a loss was directly caused by ClimbX's breach of these terms, an unauthorized action by ClimbX, ClimbX's failure to follow your instructions, gross negligence, wilful misconduct, or a liability that cannot legally be excluded.
To the maximum extent permitted by law, our total liability for any claim related to ClimbX is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, or consequential damages. These limits do not apply to gross negligence, wilful misconduct, unauthorized publishing by ClimbX, breaches of confidentiality or security where liability cannot validly be excluded, statutory consumer rights, or any other liability that cannot legally be limited. Nothing in these terms excludes or limits a consumer right that cannot legally be excluded or limited.
11. Termination
We may suspend or terminate accounts that violate these terms (including rate-limit and abuse-prevention rules) without refund. You may request deletion of your account at any time by emailing support. On deletion, we delete or anonymize account data through a reviewed process, normally within 30 days. Billing and invoice records are kept as long as required by law, and anonymized, aggregated baselines may persist because they no longer identify you. Public posts analyzed from other accounts may still be personal data relating to those account holders and are handled as described in the privacy policy.
12. Changes
We may update these terms. Material changes will be communicated by email or in-app banner at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
13. Governing law
These terms are governed by the laws of Denmark, without regard to conflict-of-law principles. Disputes will be resolved by the competent courts in Copenhagen, Denmark, except where mandatory consumer-protection laws in your country give you a different venue.
